Terms of Use

Booking/purchase of Tini Media services and products indicate that you have read, understood, and accepted the terms and conditions listed below. Tini Media takes no responsibility for any commitment to book or purchase any of our services without having regard to our terms and conditions.  

Privacy

We may collect certain personal information about you through your booking/purchase. All information about our clients is kept confidential. We undertake not to disclose or sell any information to third parties for commercial, marketing, or any other purpose.

Booking and Payment

To secure our commitment to your event, an initial deposit payment of 50% of the selected service or item is required. Your booking is not confirmed until this deposit is received. 

We must receive the final payment no less than 14 days before your event. If you book within 14 days of the event, you must make a non-refundable full payment within 48 hours of booking. For last-minute bookings within 48 hours of your event, you must make a full non-refundable payment immediately upon booking.

Travel Fee

There is no travel fee for events within a 20-kilometer radius of our location (Hofoa at the West side and Tofoa at the East). There is a travel surcharge ranging from $50-$80 depending on the location for events taking place outside of our 20-kilometer radius. 

Overtime crewing and service delivery extensions may result in additional fees of T$100 per hour (subject to our availability).  

Failure to make payment on the due date will result in a 10% interest charge on the outstanding amount, calculated on a fortnightly basis until the payment is made in full.

Cancellation  

With a cancellation no less than 10 days before the event takes place, the client is entitled to a full refund of payment made. Cancellation between 5-10 days before the event takes place entitles the client to half of the payment made. 

Cancellation in less than 5 days before the event takes place results in full payment forfeiture.

Postponement and Rescheduling

A 10-day notice is required for changes to the time and date of the event. A date change is subject to our availability. Payments already made will be transferred to the new date. However additional administrative costs may apply. If our service is unavailable for the new date, then the refund follows the cancellation policy above.

Marquee LOVE Letter and Photo Booth Services 

Depending on which type of photo booth is booked, the required space ranges from 1.5m x 1.5m to 3m x 3m. It must have access to 10A, 240V power. For an outside event, a shady place and a steady flat platform should be designated for the booth station and marquee letters. All letters are 1.4 m high and vary in width. The V, which is the widest at 1m would require sufficient space. The marquee letters are free-standing, but they must be in an area that is protected from wind and rain. If you are hosting an outdoor event, you must let us know. A weather check must be conducted to ensure safety from rain and strong winds.

Hiring, Delivery, and Services 

Set up and removal of our items are included in the service packages we offer. The Photo Booth takes about an hour to set up, and about 45 minutes to break down and remove. 

A trained and friendly photo booth attendant will always be with the photo booth to ensure the smooth running of our services during the event. No food and drink are allowed at the photobooth-allocated station at all times. Props are not to be taken or used outside the allocated photobooth props area or used for any other reason outside of Tini Media services. Outside photographers are not permitted during Tini Media paid photography sessions without prior written consent from Tini Media.

Staff Meals

The provision of meals for our staff is appreciated, especially for events that are running for 4 hours or more. However, it is not mandatory.

Use of Images: Photo Booth Services 

Photos taken in the Photo Booth MAY BE used by Tini Media for promotional materials and advertisements. You must clearly express to us that you do not agree to your photos being used by Tini Media in this respect. If you withhold your permission, we will destroy copies of the images in our possession after 30 days of the event or after final copies are delivered to you.

Use of Images/ Videos 

All photos/ videos belong to Tini Media. Clients are entitled to selected photos/videos according to the package purchased. Additional photos/videos will be charged separately. Photos/videos released to clients are edited where necessary to produce the highest quality. No raw or unedited photos/videos are to be released to clients. A PRINT RELEASE PERMIT will be issued to clients for any commercial use of our photos and videos. Photos and videos are not to be reproduced without prior knowledge and consent of Tini Media.

Commercial license 

Tini Media grants the client a non-exclusive, non-transferable license to use photographs/videos by Tini Media for commercial purposes. The photographer retains all copyrights and ownership of the photographs/ videos. The client may not modify, sell, distribute, or license the photographs/ videos to any third party without our prior written consent. The print release permit is valid from the date of payment in full and is conditional upon compliance with the terms and conditions of this agreement.  Tini Media shall not be responsible for the client’s use of photos/videos that are in breach of any law of Tonga.

Photo Storage – this applies to all Services

Images are archived after 60 days, and there is a retrieval fee. They are only archived for 100 days (or longer by agreement), but we do not guarantee the reliability of any storage device.

Model Call 

The client must follow our instructions to produce the intended result. The client must sign a contract prior to starting the model call session. All model call shoots are free. No raw files or unedited photos from the model call session will be released. The client will only get the advertised number of edited photos agreed upon with the package they paid for. Additional photos can be purchased separately.

Indemnification 

Tini Media will not be liable for failing to perform under the Agreement due to the occurrence of any event beyond our reasonable control, including power outage or interruption of service, communication outage, failure by a service provided to us to perform (no show), fire, threatened or actual act of terrorism, natural disaster, or war. The hirer agrees that, in all circumstances, the liability of the service booked is limited to an amount equal to the booking cost. We will not be liable for indirect or consequential damages. An equipment fault that may arise during the event will be rectified as soon as possible. If a power or venue outage lasts longer than 30 minutes, Tini may refund your payment on a pro-rata basis. 

 

Miscellaneous-Photo Booth and Marquee Letter Rental Services 

Tini Media reserves the right to discontinue the use of our products at any time during an event if we believe they are being misused by the clients and others through them, in a way that is hazardous to anyone or potentially harmful to the product. No refund will be available in such circumstances.

Photographs and Videography Turn-around 

The quoted session(s) (Private functions) are to be edited and have a turnaround time of 2-3 weeks (low peak season) and 4-5 weeks (high peak season). Any urgent turnaround requests of less than two weeks will be charged an additional fee of T$150 to the quoted package price. Re-copying of any previous project(s) after the final handover may result in additional charges. 

Turnaround time from Photo Booth services 

Photos/Videos taken at photo booths may be available within 48 - 72 hours of your event day, depending on the package you purchased.
